MARIA CANINE CARE CONSULTANT DOG WALKING & PET SITTING SERVICES TERMS & CONDITIONS
Professional care • Welfare-led • Individualised support
These Terms & Conditions apply to all dog walking, pet sitting and home visit services provided by Maria Canine Care Consultant.
Agreement
These Terms and Conditions set out the agreement between Maria Canine Care Consultant ("the Walker", "I", "me" or "my") and the client ("the Client", "you" or "your") for the provision of dog walking, pet sitting and/or home visit services. By booking my services and accepting these Terms and Conditions, you agree to provide accurate and complete information about yourself, your home and your pet(s), and to comply with these Terms and Conditions. I agree to provide the agreed services with reasonable care and skill and to treat your pet(s) with care, kindness and respect.
Service
Services may include:
· Dog walking
· Solo dog walking
· Suitable social/group dog walking
· Puppy or adolescent walks, where agreed
· Pet sitting
· Home visits
· Feeding and toilet breaks
· Other agreed pet-care services
The specific service, date, time, duration and price will be agreed with you before the service takes place. Any additional services requested by you may be subject to an additional charge.
Dog Walking
I will take reasonable steps to ensure that your dog is exercised and cared for safely during the agreed walk. Dogs will normally be walked according to the arrangements agreed with you. However, I retain discretion over whether a dog is suitable for a particular walking environment or for walking alongside another dog. Although I may walk suitable dogs together with your consent, no more than three dogs will be walked at one time by an individual Walker, unless otherwise agreed in writing. A dog may be walked separately from other dogs if I consider this to be more appropriate for its welfare, safety or behaviour. I may also change the walking arrangement where circumstances arise that make the originally agreed arrangement unsuitable or unsafe.
Behaviour, Temperament and Safety Information
The Client must provide complete and accurate information about their dog(s), including, where applicable:
· Aggression or attempted aggression
· Biting or previous bite incident
· Reactivity towards people or animals
· Fear, anxiety or known triggers
· Escape or bolting behaviour
· Resource guarding
· Recall difficulties
· Behaviour around traffic, livestock or other animals
· Any previous incidents involving walkers, other dogs or members of the public
· Any medical conditions, allergies or medication
Any other information that could reasonably affect the safe care or handling of the dog
You must inform me immediately if there is any change to your dog's health, behaviour, circumstances or medication. Failure to disclose information that could affect the safe provision of the service may result in the service being suspended or terminated.
Equipment
The Client is responsible for providing suitable and properly fitting equipment for their dog(s), including, where required:
· Collar
· Identification tag
· Harness
· Lead
· Long line
· Muzzle
Any other agreed safety equipment
The Client is responsible for ensuring that all equipment supplied is safe and suitable for the dog. Where a muzzle is required for safety or has been agreed as part of the dog's care plan, the Client must provide a suitable muzzle and ensure that the dog has been appropriately introduced to it.
Identification and Microchipping
The Client is responsible for ensuring that their dog is appropriately identified and that their contact details are kept up to date. The Client is also responsible for complying with any applicable legal requirements relating to identification and microchipping.
Dog Waste
I will make reasonable efforts to pick up and dispose of dog faeces produced during a walk, using the facilities or arrangements reasonably available to me.
Pet Sitting and Home Visits
Where pet sitting or home visits are booked, the agreed visit times and services will be confirmed with the Client in advance. The Client must provide clear written instructions covering the care of the pet(s), including where applicable:
· Feeding
· Fresh water
· Medication
· Toilet arrangements
· Litter trays
· Access to the garden
· Access to or from the property
· Other relevant care requirements
· Emergency contact details
· Veterinary details
I will follow the reasonable care instructions provided by the Client. If medication is required, the Client must provide clear instructions and the medication in its original packaging where appropriate. I will only administer medication where I have agreed to do so and where it is reasonably safe for me to administer it. Unless specifically agreed otherwise, I am not responsible for veterinary treatment, grooming, training or other specialist services.
Access to the Property
The Client must provide safe and reliable access to the property. Keys, access codes, key safes, remote controls and other access devices must be provided securely. The Client should not leave keys in insecure or publicly accessible locations, such as under a doormat, plant pot or wheelie bin. Where the Client chooses to leave a key in an insecure location, they accept the risk associated with doing so, except where loss or damage is caused by my negligence or other circumstances for which I am legally responsible. I will take reasonable care of all keys, access devices, security information and personal information provided to me. Keys and other access devices will be returned to the Client or dealt with according to the agreed arrangements when they are no longer required.
Home Security
The Client must provide accurate information about alarms, locks, gates, doors, security systems and access arrangements. I will take reasonable care to secure the property after each visit. The Client remains responsible for ensuring that the property and its security systems are safe and in working order.
Weather and Environmental Conditions
The safety and welfare of both the dog and the Walker will always be considered when deciding whether a walk can safely take place. Where weather or environmental conditions present a significant risk, I may:
· Shorten or alter the walk
· Change the route
· Postpone the walk
· Cancel the walk
· Offer a home visit instead, where practical and agreed
Examples may include extreme heat, severe storms, flooding, ice, dangerous conditions or other circumstances that could reasonably place the dog or Walker at risk. Where a walk is cancelled by me because conditions are unsafe, I will communicate this to the Client as soon as reasonably possible and, where appropriate, discuss an alternative service or rearrangement.
Emergencies and Veterinary Treatment
In the event of an emergency involving your pet, I will attempt to contact you, or your nominated emergency contact, as soon as reasonably practicable. If you cannot be contacted and I reasonably believe that veterinary treatment is necessary to protect the health or welfare of your pet, I am authorised to seek veterinary assistance. The Client authorises me to transport the pet to a veterinary practice if reasonably necessary. The Client remains responsible for veterinary fees and other treatment costs relating to their pet, except where such costs arise directly from my negligence or other breach of my legal obligations. The Client should provide current veterinary contact details and an emergency contact who can make decisions on their behalf where possible.
Illness or Injury
The Client must inform me of any known illness, injury, medical condition, medication or other health issue affecting their pet. I reserve the right to decline or modify a service if I reasonably believe that providing the service could place the pet, myself or another person or animal at risk. If a pet becomes unwell or injured while in my care, I will take reasonable steps to protect its welfare and contact the Client or emergency contact.
Aggressive or Dangerous Behaviour
The safety of the Client's pet, the Walker, other animals and members of the public is a priority. If a dog displays aggressive, dangerous or otherwise unsafe behaviour that was not disclosed to me, or if circumstances arise that mean I can no longer safely provide the agreed service, I may suspend or terminate the service. Where reasonably possible, I will discuss the situation with the Client and consider whether an alternative arrangement can safely be made. In serious circumstances, I may terminate the service immediately. Any payment due for services already provided remains payable. Where a service is cancelled before it takes place, any refund or payment due will be dealt with fairly having regard to the circumstances and applicable law.
False or Incomplete Information
The Client must ensure that all information provided about themselves, their property and their pet(s) is accurate and complete. If significant information has been deliberately withheld or provided inaccurately and this affects the safety or proper provision of the service, I may suspend or terminate the agreement. Any decision to terminate will be made reasonably and in accordance with applicable law.
Cancellation by the Client
The Client may cancel an individual booking or terminate this agreement by telephone, text message or email. For individual dog walks, home visits or pet-sitting appointments, a minimum of 24 hours' notice is requested. Where a Client cancels less than 24 hours before a scheduled service, the full agreed fee may be charged, where this represents a reasonable reflection of the loss incurred by the Walker as a result of the late cancellation. Where possible, I may waive or reduce the charge where the circumstances justify doing so.
Cancellation by the Walker
I may cancel or rearrange a service where there is a genuine and reasonable reason, including:
· Extreme or unsafe weather
· Emergency
· Illness
· Injury
· Unsafe behaviour
· Unexpected circumstances affecting the safety of the pet or Walker
· Circumstances outside my reasonable control
Where I cancel a service and payment has already been made for that service, I will offer an appropriate alternative where reasonably possible or provide a refund for a service that has not been provided, subject to any rights or obligations arising under applicable law. Where I cancel an individual service with less than 24 hours' notice for reasons within my control, I will not charge the Client for that cancelled service.
Contract Termination
Either party may terminate this agreement by giving written notice by email or text message. Unless immediate termination is reasonably necessary for safety or another serious reason, the agreed notice period will be 7 days. Either party may terminate the agreement immediately where there has been a serious breach of these Terms and Conditions or where continuing the arrangement would create a significant safety or welfare concern. Termination does not affect any payment already due for services that have been provided.
Payment
The Client agrees to pay the agreed price for the services provided. Payment method: Bank transfer or cash. Payment due: Within 24 hours of receiving the invoice. Any additional charges will be agreed with the Client before they are incurred wherever reasonably possible. If an invoice remains unpaid, I may suspend future services until the account has been brought up to date. Nothing in this section affects the Client's statutory rights.
Prices
Prices will be agreed with the Client before services are provided. Where prices are changed, the Client will be given reasonable notice before the new prices apply. Any existing booking already confirmed at an agreed price will not be retrospectively increased unless otherwise agreed with the Client.
Insurance
I maintain appropriate insurance for the services that I provide. Details of my insurance can be made available to the Client upon reasonable request. Nothing in these Terms and Conditions is intended to exclude or restrict liability that cannot legally be excluded or restricted.
Responsibility and Liability
I will provide the agreed services with reasonable care and skill. The Client remains responsible for providing accurate information and appropriate equipment and for informing me of any known risks associated with their pet or property. The Client is responsible for loss, damage or injury caused by their pet where this results from the pet's behaviour or circumstances for which the Client is responsible, subject to applicable law and any responsibility that may arise from my own negligence or breach of contract. I will not be responsible for loss or damage that is caused by circumstances outside my reasonable control, except where the law provides otherwise. Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence.
Indemnity
The Client agrees to reimburse me for reasonable losses, costs or expenses arising from inaccurate or incomplete information provided by the Client, or from damage caused by their pet, except to the extent that such loss or damage was caused by my negligence, breach of contract or other circumstances for which I am legally responsible.
Other Clients and Dogs
The Client acknowledges that I provide services to other clients. Where appropriate and with the Client's knowledge and consent, their dog may be walked alongside another suitable dog or dogs. I will use my professional judgement when deciding whether dogs are suitable to walk together. The maximum number of dogs walked by one individual Walker will normally be three dogs at any one time. I may decide that a dog should be walked alone or that a group arrangement should be changed if I consider this necessary for safety, welfare or behavioural reasons.
Off-Lead Walking
A dog will only be allowed off lead where this has been specifically agreed with the Client and where I consider the location and circumstances to be reasonably safe. The Client acknowledges that off-lead walking carries additional risks, including the possibility of a dog becoming lost, injured or involved in an incident with another animal or person. I may decide not to allow a dog off lead where I consider it unsafe to do so.
Dogs Running Loose or Escaping
The Client accepts responsibility for ensuring that gates, doors, fencing and other means of securing their property are in a suitable condition. If a dog escapes or runs loose because of a defect or failure in the Client's property, equipment or instructions, I will take reasonable steps to recover and safeguard the dog. Where an escape occurs due to my negligence, I will take responsibility to the extent required by law.
Personal Information and Confidentiality
I will take reasonable steps to keep confidential the Client's personal information, property access information, keys, security codes and information relating to their pets. I will only use personal information as reasonably necessary to provide the agreed services, administer the client relationship, maintain records, deal with emergencies and comply with my legal obligations.
Photographs and Social Media
I will not use photographs or videos of the Client's pet for advertising, social media or promotional purposes without the Client's permission. Permission for photographs/videos should be provided through the Client & Pet Information Form. If permission is given, it may be withdrawn by the Client at any time for future use.
Force Majeure
I will not be responsible for failure or delay in providing services where this is caused by circumstances beyond my reasonable control. This may include serious illness, accident, extreme weather, road closures, natural events, emergency situations or other circumstances that could not reasonably have been anticipated or avoided. Where possible, I will notify the Client and discuss alternative arrangements.
Complaints
If you have a concern about the service provided, please contact me as soon as reasonably possible so that I have an opportunity to understand the issue and try to resolve it. I will consider complaints fairly and respond within a reasonable time. Nothing in this section limits your statutory rights.
Changes to These Terms
Any significant changes to these Terms and Conditions will be communicated to the Client before they take effect. Changes will not retrospectively alter services that have already been provided or bookings that have already been agreed, unless otherwise agreed between the parties or required by law.
Governing Law
These Terms and Conditions are governed by the law of England and Wales. Nothing in these Terms and Conditions affects any statutory rights available to the Client.
